GENERAL TERMS AND CONDITIONS OF USE

GENERAL PROVISIONS

  1. The Gift Card (the “Card”) is the property of the issuer thereof, Mr. Paanwala.Inc (hereinafter, the “Company”). The holder of the Card is a mere depositary.
  2. The Card is available in the following formats:
    • Physical Card: For sale at any participating Mr. Paanwala.Inc physical points of sale (Cafes/Stores) within the United States.
    • Virtual Card: For sale via the official website.
  3. The Card can be used solely for the purchase of products at Mr. Paanwala.Inc stores or via the official website within the United States. It cannot be used in any other country or on any third-party marketplace unless explicitly stated.

PAYMENT AND ACQUISITION

  1. The price of the Card can be paid by any of the means of payment accepted at Mr. Paanwala.Inc on the website.
  2. Restriction: Gift Cards shall not be paid for by means of another Gift Card.

RETURN OF THE CARD

  1. Virtual Cards: Purchased via the website may be returned within 30 DAYS from the date of dispatch to the recipient.
  2. Refund Method: The price paid for the Card shall be refunded using the same means of payment used for the purchase. The original sales receipt or return document must be produced.
  3. Exceptions: Perishable products purchased with a Gift Card cannot be returned for a cash refund; any eligible return of merchandise (hoodies/t-shirts) will result in the balance being credited back to a Gift Card or Voucher.

USE OF THE CARD

  1. The Card can be used as often as the holder would like until the total balance has been exhausted.
  2. The remaining balance on the Card is the difference between the balance available prior to a purchase and the amount of that purchase.
  3. The balance can be checked at the official website in the "Gift Card" section.
  4. Unless evidence is given to the contrary, the balance of the Card shall be the one determined by the Company's point-of-sale system.

VALIDITY AND EXPIRATION

  1. No Expiration: In accordance with standard US e-commerce practices and specific state laws, the Card does not have an expiration date and shall remain valid until all value stored on the Card is used.
  2. No Fees: No dormancy, inactivity, or service fees will be charged against the balance of the Card.

RETURN OF PRODUCTS PURCHASED WITH THE CARD

  1. Products purchased with the Card are subject to the same exchange and return policy as any other products purchased (see General Terms & Conditions regarding perishable goods).
  2. Refunds for eligible returned products shall be made by increasing the remaining balance of the Card. If the original Card no longer exists, the refund will be issued via a Voucher Card (sent by email for online returns or handed out in-store).

LIABILITY AND CUSTODY

  1. The Card is a bearer instrument. The holder shall be solely responsible for the use and custody of the Card.
  2. The Company shall not replace the Card in the event of theft, loss, or damage.
  3. Cards obtained through unlawful means shall be null and void. They shall not be used to purchase products, nor shall the price thereof be refunded.

PROMOTIONAL USE

The Gift Card shall not be used for the purposes of advertising or promoting products or services marketed by any third party other than Mr. Paanwala.Inc, unless prior written consent is given by the Company.

ACCEPTANCE

The purchase and/or use of the Card entails the full acceptance of these Terms and Conditions, which have been made available to the customer upon purchase and are permanently available on the Mr. Paanwala.Inc website.
